REGULATIONS OF THE ONLINE STORE By Clödie from April 1, 2018

    1. Definitions

      The terms used in the Regulations mean:

      1. Customer - a natural person, legal person or an organizational unit which is not a legal person, the special provisions of which grant legal capacity, which places Orders within the Store;
      2. Consumer - in accordance with art. 22 [1] of the Civil Code means a natural person making a legal transaction with an entrepreneur not directly related to his business or professional activity.
      3. Civil Code - Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);
      4. Regulations - these Regulations for the provision of electronic services as part of the By Clödie online store;
      5. Online Store (Store) - website available at byclodie.pl through which the Customer may in particular place Orders;
      6. Goods - products presented in the Online Store;
      7. Sales contract - a contract for the sale of Goods within the meaning of the Civil Code, concluded between 'BY CLÖDIE' KLAUDIA TRZEPIZUR and the Customer, concluded using the Store's website;
      8. Act on consumer rights - Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827);
      9. Act on the provision of electronic services - Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);
      10. Order - Customer's declaration of intent, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and quantity of the Good.

      11. General provisions
        1. These Regulations set out the rules for using the online store available at: byclodie.pl.
        2. These Regulations are the regulations referred to in art. 8 of the Act on the provision of electronic services.
        3. The online store, operating at: byclodie.pl, is run by 'BY CLÖDIE' KLAUDIA TRZEPIZUR.
        4. These Regulations specify in particular:
          1. rules for registering and using an account as part of an online store;
          2. terms and conditions for electronic booking of products available as part of the online store;
          3. terms and conditions for electronic submission of Orders as part of an online store;
          4. rules for concluding Sales Agreements using services provided as part of the online store.
          5. Using the online store is possible provided that the ICT system used by the Customer meets the following minimum technical requirements:
            1. Internet Explorer version 10 or newer with JavaScript enabled, or
            2. Edge version 12 or later with JavaScript enabled, or
            3. Chrome version 65 or later with JavaScript enabled, or
            4. Firefox version 59 or newer with JavaScript enabled, or
            5. Opera version 52 or later with JavaScript enabled, or
            6. Safari version 7 or newer with JavaScript enabled, or
            7. minimum screen resolution of 1024 x 768 pixels.
            8. In order to use the online store, the Customer should get access to a computer station or end device with Internet access on its own.
            9. In accordance with applicable law, 'BY CLÖDIE' KLAUDIA TRZEPIZUR reserves the right to limit the provision of services via the Online Store to persons who are at least 18 years of age. In this case, potential customers will be notified of the above.
            10. Customers can access these Regulations at any time via the link on the main page of the byclodie.pl website and download it and print it.

            11. In order to use the online store, the Customer should get access to a computer station or end device with Internet access on its own.
            12. In accordance with applicable law, 'BY CLÖDIE' KLAUDIA TRZEPIZUR reserves the right to limit the provision of services via the Online Store to persons who are at least 18 years of age. In this case, potential customers will be notified of the above.
            13. Customers can access these Regulations at any time via the link on the main page of the byclodie.pl website and download it and print it.

            14. Rules for using the Online Store
              1. A condition for starting to use the Online Store is registration under it.
              2. Registration takes place by completing and accepting the registration form provided on one of the Store's websites.
              3. The condition of registration is to agree to the content of the Regulations and provide personal data marked as mandatory.
              4. 'BY CLÖDIE' KLAUDIA TRZEPIZUR may deprive the Customer of the right to use the Online Store, as well as limit his access to part or all of the resources of the Online Store, with immediate effect, in the event of the Customer's violation of the Regulations, and in particular if the Customer:
                1. provided during registration in the Online Store untruthful, inaccurate or outdated data, misleading or violating the rights of third parties,
                2. committed through the Online Store infringing personal rights of third parties, in particular the personal rights of other customers of the Online Store,
                3. will commit other behaviors that will be recognized by 'BY CLÖDIE' KLAUDIA TRZEPIZUR as behaviors that do not comply with applicable law or the general principles of using the Internet, or which violate the good name 'BY CLÖDIE' KLAUDIA TRZEPIZUR.
                4. A person who has been deprived of the right to use the Online Store may not register again without the prior consent of 'BY CLÖDIE' KLAUDIA TRZEPIZUR.
                5. To ensure the security of the transmission of messages and data in connection with the services provided as part of the Website, the Online Store takes technical and organizational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent the unauthorized acquisition and modification of personal data sent in online.
                6. The customer is obliged in particular to:
                  1. not to provide or transfer content prohibited by law, e.g. content that promotes violence, defamatory or violates personal rights and other rights of third parties,
                  2. use the Online Store in a way that does not interfere with its functioning, in particular through the use of specific software or devices,
                  3. not to take actions such as sending or posting unsolicited commercial information (spam) as part of the Online Store
                  4. use the Online Store in a way that is not inconvenient for other customers and for 'BY CLÖDIE' KLAUDIA TRZEPIZUR,
                  5. use any content posted as part of the Online Store only for personal use,
                  6. use the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general principles of using the Internet.

                  7. Procedure for the conclusion of the Sales Agreement
                    1. Information about the Goods provided on the Store's websites, in particular their descriptions, technical and functional parameters as well as prices, constitute an invitation to conclude a contract, within the meaning of art. 71 of the Civil Code.
                    2. In order to conclude the Sales Agreement via the Online Store, go to the byclodie.pl website, select the product, taking further technical actions based on the messages displayed to the Customer and information available on the website.
                    3. The choice of Goods ordered by the Customer is made by adding them to the basket.
                    4. When placing the Order - until you press the button "e.g. I order with the obligation to pay or other information indicating the obligation to pay "- the Customer has the option of modifying the entered data and the selected Good. To do this, follow the displayed messages and information available on the website.
                    5. After the Customer using the Online Store has provided all necessary data, a summary of the placed Order will be displayed. The summary of the Order placed will contain information on:
                      1. subject of the order,
                      2. unit and total price of ordered products or services, including delivery costs and additional costs (if any),
                      3. selected payment method,
                      4. selected delivery method,
                      5. delivery time,
                      6. In order to send an Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the "I am ordering with payment obligation" button.
                      7. Sending the Order by the Customer constitutes a declaration of will to conclude the 'BY CLÖDIE' KLAUDIA TRZEPIZUR Sales agreement, in accordance with the Regulations.
                      8. After placing the Order, the Customer receives an email containing the final confirmation of all relevant elements of the Order.
                      9. The agreement shall be considered concluded upon receipt by the Customer of the e-mail message referred to above.
                      10. The sales contract is concluded in Polish, in accordance with the Regulations.
                      11. Customers can access these Regulations at any time via the link on the main page of the byclodie.pl website and download and print it.
                      12. Consolidation, protection and disclosure of Order data and General Terms and Conditions (online store regulations) takes place via email.

                      13. Delivery
                        1. The delivery of Goods is limited to the area of ​​the Republic of Poland and takes place at the address provided by the Customer when placing the Order.
                        2. Delivery of ordered Goods is done by courier DPD and InPost Parcel Lockers. Delivery costs will be indicated when placing the Order.
                        3. The delivery deadline is from 1 to 4 business days from the day the Customer sends the Order.

                        4. Prices and payment methods
                          1. The prices of Goods are given in Polish zlotys and contain all components, including VAT (with distinction of the rate), customs and all other components.
                          2. The customer can pay the price:
                            1. by transfer to the bank account number 92 1050 1142 1000 0092 1413 7870,
                            2. payment in the IAI Pay system,
                            3. cash on delivery

                                1. Right to withdraw from the contract
                                  1. Only the Customer who is also a Consumer is entitled to a 14-day withdrawal period. The consumer has the right to withdraw from this contract within 14 days without giving any reason. The deadline to withdraw from the contract expires after 14 days from the day on which you came into possession of the item or on which a third party other than the carrier and indicated by you came into possession of the item.
                                  2. To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post, fax or e-mail).
                                  3. You can use the model withdrawal form, but it is not mandatory.
                                  4. To meet the deadline to withdraw from the contract, it is enough for you to send information regarding the exercise of your right to withdraw from the contract before the deadline for withdrawing from the contract.

                                  5. Consequences of withdrawal
                                    1. In the event of withdrawal from this contract, we will refund you all payments received from you, including the cost of delivery (except for additional costs arising from your chosen delivery method other than the cheapest usual delivery method offered by us), immediately and in any case no later than 14 days from the day on which we were informed of your decision to exercise the right to withdraw from this contract. Reimbursement will be made using the same payment methods that you used in the original transaction, unless you have expressly agreed otherwise; in any case, you will not incur any fees in connection with this refund.
                                      1. Complaints about the Goods
                                        1. 'BY CLÖDIE' KLAUDIA TRZEPIZUR as the seller is liable to the Customer who is a Consumer within the meaning of art. 22 [1] of the Civil Code, under the warranty for defects in the scope specified in the Civil Code, in particular in art. 556 and art. 556 [1] - 556 [3] and subsequent Civil Code.
                                        2. Complaints arising from violation of statutory guaranteed rights, or on the basis of these Regulations, should be addressed to kontakt@byclodie.pl. 'BY CLÖDIE' KLAUDIA TRZEPIZUR undertakes to consider each complaint within 14 days. Failure to consider a complaint within the above deadline means that it is justified.
                                        3. 'BY CLÖDIE' KLAUDIA TRZEPIZUR is not a producer of goods. The manufacturer is responsible for the warranty of the sold Goods on the terms and for the period indicated in the warranty card. If the warranty document provides for this possibility, the Customer may submit his claims under the warranty directly to the authorized service center whose address is in the warranty card.
                                        4. Complaints regarding the provision of electronic services
                                          1. 'BY CLÖDIE' KLAUDIA TRZEPIZUR undertakes actions to ensure the fully correct operation of the Store, to the extent that results from current technical knowledge and undertakes to remove within a reasonable time any irregularities reported by customers.
                                          2. The customer is obliged to immediately notify 'BY CLÖDIE' KLAUDIA TRZEPIZUR of any irregularities or interruptions in the operation of the Online Store website.
                                          3. Irregularities related to the functioning of the Store may be reported by the Customer in writing to the following address: kontakt@byclodie.pl or using the contact form.
                                          4. In the complaint, the Customer should provide his name, correspondence address, type and date of irregularities related to the functioning of the Store.
                                          5. 'BY CLÖDIE' KLAUDIA TRZEPIZUR undertakes to consider each complaint within 14 days. Failure to consider a complaint within the above deadline means that it is justified.
                                          6. Dispute resolution and final provisions
                                            1. The Customer who is a Consumer may, if interested, use extrajudicial means of dealing with complaints and redress. Disputes regarding online purchases can be resolved through mediation proceedings before the Provincial Inspectorates of the Trade Inspection or a trial before the arbitration court at the Provincial Inspectorate of the Trade Inspection. The consumer may also use other methods of out-of-court dispute resolution and e.g. lodge his complaint via the EU ODR online platform available at: http: //ec.europa.eu/consumers/odr/
                                            2. If the Consumer is not interested in the possibility of using out-of-court dispute settlement methods, settlement of any disputes arising between 'BY CLÖDIE' KLAUDIA TRZEPIZUR and the Consumer will be subjected to courts having jurisdiction in accordance with the relevant provisions of the Code of Civil Procedure.
                                            3. Settlement of any disputes arising between 'BY CLÖDIE' KLAUDIA TRZEPIZUR and a Customer who is not also a Consumer will be subject to the court having jurisdiction over the seat of 'BY CLÖDIE' KLAUDIA TRZEPIZUR.
                                            4. In matters not covered in these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of electronic services and other relevant provisions of Polish law shall apply.
